Guest Rental Agreement
This Agreement governs every confirmed Booking made through Book Oside Direct. By completing checkout, the Guest accepts these terms.
1. Parties
This Guest Rental Agreement is entered into between the Host of the booked Property and the Guest completing the reservation. Book Oside Direct (the “Company”) facilitates the Booking as a technology platform and limited payment collection agent for the Host, and is not itself the landlord unless expressly stated in the Listing.
2. Reservation and payment
- A Booking is confirmed when payment is authorized and the reservation status is “Confirmed” on the Platform.
- Booking Fees include the nightly subtotal, cleaning fee (if any), the 7% service fee, the damage protection fee, and applicable taxes including the City of Oceanside TOT (currently 11.5%). The total is shown at checkout before purchase.
- Payment is processed by our third-party payment processor. The Guest represents they are authorized to use the payment method provided.
3. Check-in and check-out
- Check-in and check-out times are shown on the Listing and confirmation.
- Early check-in or late check-out is not guaranteed and, if approved by the Host, may be subject to an additional fee.
- Late departure without approval may result in an additional charge equal to one night's rate.
4. Occupancy
- Only the number of Guests disclosed at booking may occupy the Property. Exceeding maximum occupancy is a material breach.
- The Guest who booked must be present for the duration of the stay and is responsible for the conduct of all occupants and visitors.
- Subletting, assignment, and unauthorized events are prohibited.
5. Rules of the Property
- Guests must follow the house rules posted on the Listing, applicable HOA rules, and all City of Oceanside ordinances, including quiet hours (typically 10:00 PM – 8:00 AM) and parking rules.
- No parties or events without the Host's prior written approval.
- Smoking is prohibited indoors. Where outdoor smoking is permitted, all materials must be safely extinguished and removed.
- Pets are only permitted where the Listing expressly allows them and additional pet terms are met.
6. Damage, cleaning, and Damage Protection
- The Guest agrees to leave the Property in the condition it was received, subject to normal wear.
- The Company's Damage Protection Policy provides limited coverage for accidental damage in accordance with its terms. Intentional damage, gross negligence, and rule violations are not covered.
- Damage exceeding the Damage Protection limit, or that is excluded, may be charged to the Guest's payment method or pursued separately.
7. Cancellations and refunds
Cancellations, changes, and refunds are governed by the Cancellation & Refund Policy in effect at the time of Booking. The Company's service fee and damage protection fee are generally refundable only when the entire Booking is fully refunded.
8. Health, safety, and assumption of risk
- Guests use the Property, including any pool, hot tub, deck, beach access path, stairs, and outdoor equipment, at their own risk.
- Children must be supervised at all times.
- Guests must promptly report any safety hazard, damage, or malfunction to the Host and, if not resolved, to Book Oside Direct support.
9. Host access
The Host or its agents may enter the Property with reasonable notice for maintenance, inspection, or in the event of an emergency, in accordance with applicable law.
10. Removal for breach
Serious or repeated breaches of this Agreement — including exceeding occupancy, unauthorized parties, illegal activity, harassment of neighbors, or refusal to comply with house rules — may result in immediate termination of the stay without refund. Local law enforcement may be contacted where appropriate.
11. Force majeure
Neither the Host, the Guest, nor the Company is liable for failure to perform due to events beyond reasonable control, including natural disasters, wildfires, government orders, utility outages, or pandemics. In those situations, the Cancellation & Refund Policy controls how affected Bookings are handled.
12. Limitation of liability
To the maximum extent permitted by law, the aggregate liability of the Company arising out of or relating to a Booking will not exceed the Booking Fees paid for that Booking. Neither the Host nor the Company is liable for indirect, incidental, special, or consequential damages.
13. Governing law
This Agreement is governed by the laws of the State of California. Disputes will be brought exclusively in the state or federal courts located in San Diego County, California.
14. Acceptance
By completing checkout, the Guest acknowledges they have read, understood, and agreed to this Agreement, the Terms of Service, the Cancellation & Refund Policy, the Community Standards, and any supplemental agreement uploaded by the Host and displayed at checkout.
